Community Orders

There is a range of community penalties that the Courts may impose. Some of them are described briefly here.

• Community Rehabilitation Order

Suitable for: Offenders aged 16 years and over where clearly identified areas of need have contributed to their offending.

• Community Rehabilitation Order with additional requirements:

  • Condition to attend a Probation Accredited Programme:
    Suitable for: male and female offenders
    These Programmes challenge offending behaviour. They are designed to:

    • reduce offending by confronting offenders about their crime
    • bring about change in attitudes and behaviour to avoid re-offending
    • work on problem solving and reduce re-offending.

    The range of programmes provides sentencing options to focus on particular problems, such as alcohol, drugs, employability and access to basic skills and training through partnership arrangements with other agencies
  • Condition of Mental Health Treatment
    Suitable for: Offenders who have shown evidence of a mental disorder. A psychiatric report is required to support the order.
  • Condition of Hostel Residence
    Suitable for: Offenders, who have committed serious offences, who might otherwise be in custody and who are in need of enhanced supervision.

• Community Punishment Order

  • A minimum of 40 hours up to a maximum of 240 hours.
    Suitable for: Offenders aged 16 years and over
    • whose offence is serious enough to warrant a community sentence • who do not need or are unlikely to benefit from a Community Rehabilitation Order and where there is work available.

 

• Community Punishment and Rehabilitation Order

This order combines: Community Rehabilitation Order (1-3 year's duration) and Community Punishment Order (minimum 40 hours - maximum 1000 hours)

Suitable for: Offenders 16 years and over convicted of an offence that is of the more serious category for which a community sentence may be imposed.

• Drug Treatment and Testing Order

A minimum of 6 months up to a maximum of 3 years and will contain a request for the offender to receive treatment and be tested for the presence of drugs during the Order. This Order and the offender's progress are reviewed regularly by the sentencing court.

Suitable for: Offenders aged 18 years and over (this may be extended to 16 years and over):

  • responsible for either serious or prolific offending related to long standing drug dependency.
  • motivated to change their behaviour.
